Terms of Use
1. CHASE SC, also known as Christian
Homeschooler's Association of South Eastern South Carolina, will be referred to
as CHASE SC throughout the Terms of Use listed herein.
2. The materials
on the CHASE SC web site, CHASE SC resources, any posts, or communications in
any form are for informational purposes only. This material
is not intended to be,
and does not constitute the giving of legal advice. For information about the
laws and regulations in this state, please contact your own attorney, HSLDA
(Home School Legal Defense
Association), NHELD (National Home Education Legal Defense), or PPL (Pre-Paid
Legal).
3. Use of the CHASE SC web site, newsletter
group, and any other program, resource or group related to CHASE SC is
voluntary, and you waive any and all claims against CHASE SC, board members, or
others associated with CHASE SC arising out of your use of the site, materials,
information, programs, links, opinions, recommendations and any other use on
this site, or use of a CHASE SC provided resource.
4. CHASE SC may modify the terms of use at
any time. If modification is unacceptable to you, the only recourse you have is
to not use this site, or other CHASE SC provided resources. Your continued use
of the CHASE SC web site or CHASE SC resource after any modification of the
Terms of Use constitutes the acceptance of the modifications.
5. Everything on
the CHASE SC web site and any CHASE SC provided resource is copyrighted, you can
only use, and make copies of those items that we specifically give permission to
do so. You are not allowed under any circumstances to make copies for the sole
purpose of selling any information, documents, or other materials from the CHASE
SC web site.

SC copyrighted information, documents, or other materials from the CHASE SC web
site, or a CHASE SC resource may result in civil and criminal copyright
infringement penalties.
6. The CHASE SC
web site is presented as an "as is" "as available" basis. CHASE SC makes no
warranty to any materials, documents, files, data, information, resources, or
anything else on or related with the CHASE SC web site or CHASE SC resource; nor
any warranty to the availability of the web site, any materials, documents,
files, data, information, resources, or anything else on or related with the
CHASE SC web site.
7. Any unsolicited
materials, ideas, data, items, or products that are sent to CHASE SC will be
considered CHASE SC property. As CHASE SC property, we will determine the use
of such material. We may or may not treat the material as confidential, and you
agree that we will not be held liable for disclosure, non-disclosure, or any
other use of said materials.
8. CHASE SC, has
an expectation of privacy and confidentiality by anyone who contacts CHASE SC by
phone, fax, email, US Mail and any other form of communication, and or
delivery. You may not modify, copy, distribute, transmit, display, perform
reproduce, publish, license, create derivative works from, transfer, make public
or sell any information from the CHASE SC web site, obtained from CHASE SC by
email, fax, cellular and phone conversations, meetings, in person conversations,
association issued paperwork, documents, or any other form of communication.
9. CHASE SC will not be liable for any
direct, indirect, special or consequential damages, any loss of revenue,
profits, or data of any kind arising in connection with the use of the CHASE SC
web site, or other CHASE SC resource, even if CHASE SC has been advised of the
possibility of such damages. Further, you agree our liability arising from this
agreement will not exceed the amount you paid us, if any for accessing the CHASE
SC site, or other pertinent CHASE SC resource.
10. You will defend
and hold harmless CHASE SC, its parents, subsidiaries, affiliates, contractors,
agent, officers, directors and members against all claims, losses, damages,
liabilities, costs and expenses (including reasonable attorneys' fees and costs)
made due to or arising out of a violation of these Terms of Use or Your use of
this Site, including, without limitation, any claim arising out of unauthorized
links to Our Site.
11. If CHASE SC fails to insist upon or
enforce strict performance any provision, right, condition, or term under these
Terms of Use, it will not be construed as a waiver of any provision, right,
condition, or term; rather, the entire Terms of Use will and shall remain in
full force and effect.
12. These Terms of
Use will be interpreted, construed, and enforced in all respects in accordance
with the laws of the State of South Carolina to the exclusion of any other law
which may be imputed in accordance with choice of law rules applicable in any
jurisdiction. The 1980 U.N. Convention on Contracts for the International Sale
of Goods or any successor thereto does not apply to these Terms of Use. For any
suit or claim pertaining to these Terms of Use or any information furnished
hereunder, You irrevocably consent to the jurisdiction and venue of any state or
federal court sitting in Colleton County, South Carolina, USA, and You will not
commence an action or proceeding relating to the subject matter of these Terms
of Use in any other jurisdiction.
13. These terms are drawn up in English; as
well as, all of CHASE SC resources. Further, it is agreed that the English
language will be used for all communications, and resources.
14. These Terms of Use will not be
interpreted, or construed by anyone to create or produce evidence of a
partnership, joint venture, franchise, nor any other relationship among the
parties. The Terms of Use are not imposing any partnership or franchise
obligation, or liability on either party.
15. You will comply, at your own expense,
with all statues, regulations, rules, ordinances, policies, and orders of any
and all governmental bodies, departments, or agencies that apply to or result
from your use of the CHASE SC site, or CHASE SC resources.
16. If any
provision or provisions of the Terms of Use are unlawful, void, or for any
reason unenforceable; then that provision will be considered separate, and will
not affect the validity and the enforceability of the remaining provisions.
